ORDER:
This Writ Petition is filed for setting aside order in proceedings No.CS1/4531/2014, dated 13.10.2014, of respondent No.3, whereby he has rejected the petitioner’s application for grant of New Food Grains licence in his favour.
A perusal of the impugned proceedings shows that the only ground on which respondent No.3 has rejected the petitioner’s application is that the Assistant Grain Purchasing Officer, Kodad has not recommended issue of Food Grains license to the petitioner. However, the learned Government Pleader for Civil Supplies (Telangana) has not disputed that the petitioner has purchased the rice mill in the auction held by the Andhra Pradesh State Financial Corporation for recovery of the arrears from M/s Sri Sainidhi Parboiled Rice Industries, Tellaballi and that there is no evidence whatsoever to show that the petitioner is in any way connected with the said M/s Sri Sainidhi Parboiled Rice Industries, Tellaballi.
In view of this undisputed position, learned Government Pleader has fairly conceded that respondent No.3 will reconsider his view and pass a fresh order in supercession of the impugned order.
In view of this fair submission of learned Government Pleader, the Writ Petition is disposed of with the direction to respondent No.3 to pass a fresh order, without being influenced by the view taken by him in the impugned order, within a period of one week from the date of receipt of a copy of this order.
As a sequel to disposal of the Writ Petition, W.P.M.P.No.39377 of 2014 filed by the petitioner for interim relief stands disposed of as infructuous.
