JUDGMENT / ORDER

THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7159 of 2010 Between:
Sri Sai Krishna Yadava Sangham Rep. by its President, Merugu kanakaiah PETITIONER AND
1. Government of Andhra Pradesh, rep. by its District Collector, Adilabad, and another.
RESPONDENTS ORDER:
This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“………issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring that the 2nd respondent has no right or authority to levy and collect any fee on sheep and goats which are maintained and sole by the members of the petitioner Sangham at their private licensed premises……”
2. When the matter is called, it is submitted by the learned Standing Counsel for the 2nd respondent-Gram Panchayat that the Gram Panchayat issued a public auction notification dated 22.03.2010 and the same is the basis for filing the present writ petition. It is further submitted by the learned Standing Counsel that the period stipulated in the said notification came to an end long back and nothing survives for adjudication in the writ petition.
3. For the aforesaid reasons, the writ petition is closed giving liberty to the petitioner to file writ petition afresh, if any fresh cause of action arises in future. No order as to costs. As a sequel, the miscellaneous petitions, if any, shall stand closed.
