. RESPONDENT WHEREAS the Petitioner above named through its Advocate Sri K. VENKATESH presented this writ petition under Article 226 of the Constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court may be pleased to issue appropriate writ or order or direction more particularly one in the nature of writ of mandamus declaring the order passed the respondent bank dt.3-10-2013 in rejecting request of the petitioner for change of collateral security offered at the time of sanction of the term loan vide A/c.No.31533480569 as illegal, arbitrary and unjust and consequently direct the respondent bank to consider the representation of the petitioner dt.12-3-2013 for change of collateral security in the interest of justice;
AND WHEREAS the High Court upon perusing the petition and affidavit filed herein and upon hearing the arguments of Sri K. VENKATESH Advocate for the Petitioner, directed issue of notice to the Respondent herein returnable in three (03) weeks to show cause as to why this writ petition should not be admitted in the circumstances set out in the petition and the affidavit filed in Writ Petition; and the court also permitted the counsel for the petitioner to take out notice to the respondent by RPAD and file proof of service.
