ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a Writ, Order or direction more particularly one in the nature of writ of Mandamus declaring the action of the respondents purporting to auction the seized stock of petitioner seized vide panchanama dated 21.02.2013 pending disposal of Criminal Appeal without there being any contravention of Control Order i.e, Andhra Pradesh Licence, Storage, Control Order, 2008 is being arbitrary, illegal and unconstitutional and violative of principles of natural justice and consequently direct the respondent authorities to release the seized stock in favour of the petitioner on furnishing the bank guarantee.”
After arguing the case, Ms.K.Hemalatha, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to her client to seek appropriate relief in connection with Crl.Appeal No.88 of 2014 pending on the file of the learned District and Sessions Judge, Khammam.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.Nos.40097 & 40098 of 2014 shall stand disposed of as infructuous.
