THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.27154 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned standing counsel appearing for the respondents.
This writ petition is filed seeking a writ of mandamus, declaring the action of the 3rd respondent in not disposing of the appeal dated 9-4-2012 as arbitrary, illegal, against the principles of natural justice and Articles 14 and 21 of the Constitution of India and consequently direct the third respondent to pass appropriate orders on it.
On the charge of absentism from 23-04-2009 to 4-
5-2009, the petitioner was removed from service. Subsequently, the petitioner filed an appeal before the third respondent and the third respondent by order dated 12-11-2009 directed re-engagement of the petitioner as fresh contract conductor and posted to Kamareddy Depot, but the petitioner could not join duty. According to the petitioner, he fell sick and he was under treatment from 12-11-2009 to 9-4-2012. Thereafter, the petitioner filed another appeal dated 9-4-2012 before the third respondent explaining the circumstances under which, he failed to join duty as per the order dated 12-11-2009. The grievance of the petitioner is that in spite of his filing the aforesaid appeal, the third respondent is not hearing the appeal and not passing appropriate order on the said appeal. Therefore, the present writ petition is filed to issue necessary direction to the third respondent.
In the circumstances mentioned above, the third respondent is directed to dispose of the appeal filed by the petitioner dated 9-4-2012 and pass appropriate orders thereon within a period of eight weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
