THIS CRL.P COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Sri N. Bayya Reddy, learned counsel has filed vakalath for respondent No.1.
2. Petitioner - Ravi and Respondent No.2 Complainant – B. Manjunath and their respective counsels are present before the court. Both the parties have filed a Joint Memo before this court and also filed an affidavit of the second respondent dated 25.10.2017. Perused the Joint Memo. The offences alleged are Sections 506, 406, 408 and 420 of IPC. The second respondent has lodged a complaint before the Rajagopal Nagar Police Station for the above said offences and a case has been registered against the petitioner in Crime No.547/2016. As the said offences are not so serious and no impact on the society, the Joint Memo filed by the parties may be accepted and the said proceedings are liable to be quashed.
3. The respondent No.2 is the complainant, who made allegations against the petitioner herein that the petitioner has received Rs.40,000/- to Rs.50,000/- from the parents of the students at the time of admission and cheated the parents etc., As the respondent No.2 himself do not want to proceed with the matter, there cannot be any further proceedings in this regard.
In view of the above said facts and circumstances of the case, the Petition is allowed by accepting the Joint Memo. Consequently, all further proceedings in Crime No.547/2016 dated 18.6.2016 registered by the Rajagopal Nagar Police Station pending against this petitioner, pending on the file of the IV Addl. CMM, Bengaluru, are hereby quashed.
