O R D E R Sri. Raunaq Sikka- petitioner No.1, Sri. Bipin Sikka- petitioner No.2, Smt. Kanchan Sikka- petitioner No.3, Ms. Amrita Sikka-petitioner No.4 and their counsel Sri. Amit Mandgi, learned Addl. SPP on behalf of respondent No.1 and Smt. Richa Sehgal- respondent No.2 and her counsel Sri. K. Shrihari are present.
2. Petitioners and respondent No.2 have filed a joint memo duly signed by petitioner Nos.1 to 4 and their counsel and respondent No.2 and her counsel. In the joint memo, it is stated that the matrimonial dispute between petitioner No.1 and respondent No.2 was referred for mediation and a settlement has been arrived at between them as per the memo of settlement dated 27.02.2015, in terms of which, marriage between petitioner No.1 and respondent No.2 has been dissolved by a decree of divorce dated 20.07.2015 in M.C.No.2185/2015. Further, it is stated that in terms of the aforesaid settlement, respondent No.2 has withdrawn all the allegations made against the petitioners leading to their prosecution in C.C.No.22470/2012. Petitioners and respondent No.2 submit that they abide by the terms of the aforesaid joint memo. Respondent No.2 submits that in terms of the aforesaid joint memo, she withdraws all the allegations made against the petitioners and requests the court to quash the proceedings initiated against the petitioners.
Having considered the nature of the allegations made against the petitioners and in view of the settlement arrived at between the parties as reflected in the joint memo, petition is allowed. The proceedings pending against the petitioners in C.C.No.22470/2012 on the file of X Addl. CMM, Bengaluru is quashed. In view of disposal of the main matter, I.A.No.1/16 for stay does not survive for consideration. Accordingly, it is disposed of.
