Heard learned counsel for the petitioners and learned Standing Counsel.
This writ petition has been filed for issuance of mandamus commanding the respondent no.1 or respondent no.3 to dispose of the stay application filed by the petitioners in revision no. 415/218530225000072 (Chaudhari Pratap Singh Vs. Gaon Sabha) under Section 48 (1) of U.P. Consolidation of Holding Act.
The contention of learned counsel for the petitioners is that petitioners is that against the order of Settlement Officer Consolidation dated 31.5.2018, petitioners filed revision on 15.6.2018 along with application for interim relief. The said application has not yet been disposed of by the Deputy Director of Consolidation as a result thereof, the petitioners are suffering from irreparable loss and they are likely to be dispossessed from the land in dispute.
Considering the facts and circumstances of the case, respondent no.1-Deputy Director of Consolidation, Fatehpur/respondent no.3-Collector, Fatehpur is directed to decide the petitioners' application for interim relief filed in revision no. 415/218530225000072 (Chaudhari Pratap Singh Vs. Gaon Sabha) as expeditiously as possible preferably within a period of three months from the date of production of certified copy of this order.
Writ petition is, accordingly, disposed of.
