Sri Sai Brindavan Layout Owners Association (R) No.92, Biayappanahalli Village Bidarahalli Hobli, Virgonagar Post Bangalore East Taluk, Bangalore-49 By its President Bhimappa Arishinagodi. …Respondents (By Sri. H. Thimmappa, Advocate for R1and R2; Sri H. Devendrappa, Advocate for R3) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to issue a writ of mandamus directing respondent No.2 to consider Annexure-D the representation dated 13.8.2014 given on 08.09.2014 by the petitioner and to pass appropriate orders within a specified period and etc.
This Writ Petition coming on for Preliminary Hearing this day, the Court made the following:
O R D E R In this writ petition, the petitioner has sought for a writ of mandamus directing respondent No.2 to consider Annexure-D representation dated 13.08.2014 given on 08.09.2014.
2. Learned counsel appearing for respondent No.2 has filed a memo dated 06.08.2019 along with an endorsement dated 07.05.2016 stating that the representation of the petitioner is considered and it is rejected. In view of the same, the writ petition does not survive for consideration.
Accordingly, writ petition is disposed off reserving the liberty to the petitioner to challenge the endorsement before the appropriate legal forum.
