THIS CRIMINAL PETITION COMING ON FOR ADMISSION, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Counsel for the petitioner is absent.
2. Perused the petition. Petitioner has sought for quashing the proceedings in CC No.20608/2014. The petitioner is shown as accused No.6. The charge sheet is filed for offences under sections 224, 225A, 225B of the Indian Penal Code, 1860 and Section 54(1)(a) of the Karnataka Prisons Act, 1963.
3. When the matter is taken up for hearing, the learned Additional State Public Prosecutor appearing for the respondent has made available a copy of the orders passed by this court in Criminal Petition Nos.3234/2015 and 3235/2015 dated 27.3.2018 whereby the petitions filed by accused Nos.2,3 and 5 under Section 482 of Criminal Procedure Code, 1973 seeking to quash the proceedings in CC No.20608/2014 are dismissed. The allegations made against the present petitioners are on par with the allegations against accused No.5, who was also a Jail Warden at Central Prison, Parappana Agrahara at the relevant point of time.
4. Since the petitioner herein is also sought to be proceeded with on the same set of facts and material, the instant petition is also liable to be rejected.
Accordingly, the petition is dismissed.
