HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 14864 of 2014 ORAL ORDER:
In accordance with Government Memo No. 7296/J2/2002-09 dated 15.10.2009, an application was submitted by the petitioner to start Multi Purpose Health Worker (Male) Training Institution. By way of communication vide letter No.282-100/APPMB/2012 dated 3.9.2012 the request of the petitioner was rejected on the ground that the inspection team found inadequate faculty in the institute, therefore no such permission can be granted.
2. Learned counsel for petitioner submits that in several other institutions second opportunity was afforded and petitioner has now complied with the requirement of adequate teaching faculty, the A.P. Para Medical Board, may re-verify the suitability of the petitioner institute to start Multi Purpose Health Worker (Male) Training Institution.
3. As disclosed by the learned counsel for petitioner so far no such application was submitted by the petitioner requesting the respondents for re-inspection of the college premises and learned counsel for petitioner submits that petitioner would now submit an application for re-inspection of the college premises.
4. Since the order dated 3.9.2012 by which the request of the petitioner was rejected was not challenged and since so far no application is submitted by the petitioner requesting for re-inspection of the premises of the institute with reference to compliance of the requirements for commencement of a training institute and as the petitioner now offers to file an application for re-inspection, the writ petition is disposed of granting liberty to the petitioner to submit an application to the A.P. Para Medical Board requesting the Board to conduct re-inspection of the premises with reference to parameters required to be fulfilled including adequate faculty. As and when such an application is filed, the second respondent-Board shall consider the same and take appropriate action as warranted by law within a period of six weeks thereof.
Accordingly the writ petition is disposed of. No costs. Sequel to the same, miscellaneous petitions, if any stand dismissed.
