Rajadithya Sadasivan, Advocate for R2) This Criminal Petition is filed under Section 482 of Cr.P.C. praying to quash the FIR pending on the file of the learned II ACMM, Bengaluru in Crime No.46/2017 filed before the Basavanagudi Women Police Station, under Sections 34, 506 and 498A of IPC, 1860 and under Section 4 of Dowry Prohibition Act, 1961 at Annexure-C by allowing this application filed by the petitioner.
This Criminal Petition coming on for Admission, this day, the Court made the following:-
ORDER In the instant petition, petitioner has sought for the following reliefs:
“a) To quash the FIR pending on the file of the learned II ACMM, Bengaluru in Cri. No.46/2017 filed before the Basavanagudi Women’s Police Station u/s 34, 506 and 498A of IPC, 1860 and under Section 4 of Dowry Prohibition Act, 1961 at Annexure “C” by allowing this application filed by the petitioner and;
b) Pass such other order or further orders as this Hon’ble Court deems fit and proper in the particular facts and circumstances of this case.”
2. During the pendency of the present petition, parties have entered into settlement in respect of withdrawing the cases. Further in the present petition, joint memo has been filed relating to settlement.
3. Learned counsel for the petitioner files a joint memo along with the documents including memo of undertaking in respect of withdrawal of complaint in NCR No.559/2017 filed before the HAL Police Station and HRC No.2171/2017 filed before the State Human Rights Commission, Andhra Pradesh.
4. In view of the joint memo of settlement read with memo of undertaking along with the memo of filing the documents dated 22.10.2019, proceedings arising out of Crime No.46/2017 pending on the file of II Additional Chief Metropolitan Magistrate, Bengaluru is set aside. Petition stands allowed.
