Vishwamurthy, HCGP) This Criminal Petition is filed under Section 439 of Cr.P.C. praying to enlarge the petitioner on bail in crime No.61/2016 (C.C. No.547/2016) of Channaptna Rural Police Station, Ramanagara District for the offence p/u/s 302 read with 34 of IPC.
This Criminal Petition is coming on for orders this day, the Court made the following:
ORDER Heard the learned counsel for the petitioner and the learned HCGP for the respondent.
2. The petitioner is charge sheeted along with three others in respect of the offence punishable under Section 302 read with 34 of IPC. His petition filed before the Sessions Court during the crime stage was dismissed vide order dated 16.06.2016. It appears the charge sheet was submitted to the Court during the pendency of the petition and there is no discussion in the order of the Sessions Court about the charge sheet material.
3. In that view of the matter, petition is rejected. Liberty is reserved to the petitioner to move fresh bail petition before the concerned Sessions Court. In that event, his petition shall be considered in accordance with law without being influenced by the earlier order of his bail petition.
