The present writ petition is filed challenging the tender notification No.NITW/CS-2/2014-15, dated 26-06-2014 on the ground of not terminating the contract of the petitioner by issuing notice for termination as contemplated in the Licence Agreement issued by the respondent vide Licence dated 21-08-2012.
When the matter is taken up for hearing, Sri Aka Venkataramana learned standing counsel for the respondent filed counter and stated on instructions that since only two tenderers have participated in pursuance of the impugned tender notification dated 26-06-2014, the tender notification was cancelled and that as per rules, there should be participation of three tenderers in the tender process.
Therefore, in view of the submission made by the learned standing counsel, the cause in the present writ petition does not survive and has become infructuous.
Accordingly, the writ petition is dismissed as infructuous, giving liberty to the petitioner to challenge any tender notification that may be issued by the respondent in future. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
