Delay Condonation Application no.5 of 2019 This is a delay condonation application filed in aid of a substitution application seeking to bring on record the heirs of the sole appellant, Ram Nageena Prasad, who has died on 22.12.2017 as disclosed in paragraph 2 of the affidavits separately filed in support of the substitution application and the delay condonation application.
When the case is called on, learned counsel for the applicant for substitution is not present. Sri Maha Prasad, learned Advocate is present on behalf of respondent no.2.
The application for condonation of delay in bringing on record the heirs of the sole appellant is accordingly dismissed in default.
Order on Civil Misc. Substitution Application no.6 of 2019 This is a belated substitution application. The application for condonation of delay in bringing this application has been dismissed in default by my order of date passed in Civil Misc. Delay Condonation Application no.5 of 2019.
This substitution application is rejected as time barred.
