JUDGMENT / ORDER

Sri Rakesh Kumar.V, S/o Late P.Venkappa, Aged about 42 years, Resident of No.106/8, Central Street, Neelasandra, Bengaluru-560 047. …Petitioner (By Sri Venugopal M.S., Advocate) And State of Karnataka, Represented by Hebbal Police, Bengaluru-560024 ….Respondent (By Sri S.Vishwamurthy, HCGP.) This criminal petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Cr.No.198/2017 of Hebbal Police Station, Bengaluru City for the offence P/U/S 504, 353, 436, 307 and 511 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent-State.
2. The petitioner is in judicial custody since 06.07.2017 in Cr.No.198/2017 registered in respect of the offences punishable under Sections 504, 353, 436, 307, 511 of IPC.
3. The allegation is, the petitioner on the night of 05.07.2017 while driving the car was intercepted by the complainant/PSI., and when checked, he was found to have consumed alcohol. Case was registered against him for drunk and drive, without uniform, not wearing seat belt, dangerous driving and misbehaving with the police. He insisted for return of his vehicle, which was refused by the PSI., since he was drunk. On that, he abused the police personnel filthily and on the early morning of 06.07.2017 he attempted to immolate the complainant by setting him ablaze etc.
4. As per the submission at the bar, his police custody was not sought for by the Investigating Officer.
Having regard to the specific nature of the allegation, the petition is allowed. Petitioner is enlarged on bail in Cr.No.198/2017 registered by the respondent-police, subject to the following conditions:
(i) He shall execute a self bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with one surety for the likesum to the satisfaction of the concerned Court.
(ii) He shall cooperate during further course of investigation and (iii) He shall not indulge in similar activities.
