4. The Circle Inspector of Police Vijaya Nagar Police Station Vijaya Nagar, Mysore-570 007. ... Respondents (By Smt. Niloufer Akbar, AGA.) This writ petition is filed under Articles 226 & 227 of the Constitution of India praying to direct the R3 to consider the representation of the petitioner dated:12.05.2011 (Annexure-F) and with further direction to transfer the case registered in FIR No.0050, dated:30.03.2011 vide Annexure-D registered at Vijayanagar police station, Mysore for fresh investigation from the R2 CID.
This writ petition, coming on for preliminary hearing in ‘B’ group this day, the Court, made the following:
ORDER The petitioner is seeking a direction to the respondents to consider his representation dated 12.05.2011 (Annexure-F). He further sought a direction to transfer the case registered in FIR No.0050, dated 30.03.2011, registered at Vijayanagar Police Station, Mysore for fresh investigation before the second respondent CID.
2. Smt.Niloufer Akbar, learned Additional Government Advocate for the respondents has filed an objection stating that the investigator has been completed and they have filed ‘B’ report. The same is produced as Annexure-R1.
3. Since the Police have filed a ‘B’ report, if the petitioner has any grievance he has to challenge the same before th appropriate legal form.
4. With the above observations, this petition stands disposed of.
