THESE WRIT PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Petitioners herein are seeking direction to respondent No.3 – Tahsildar, Bengaluru South Taluk, to consider change of katha of land bearing Sy.No.110, measuring to an extent of 4 acres, situated at Doddathogur Village, Begur Hobli, Bangalore South Taluk.
2. It is stated that the petitioners have succeeded to aforesaid land from their mother Yellamma in whose name the land in question was standing. The petitioners would also state that on an application filed by them the 2nd respondent – Tahsildar has passed an order in proceedings bearing No.RRT/CR.643/2017-18, dated 2.3.2018, at Annexure-C for carrying out necessary changes in the RTC. It is their grievance that subsequent to said order, no steps are taken by the 3rd respondent to effect change of katha and necessary revenue entries.
3. Heard the learned counsel for the petitioners as well as the learned Additional Government Advocate. Perused the order of Special Tahsildar, Bengaluru South Taluk, dated 2.3.2018. The said order would indicate that petitioners’ prayer for change of katha is accepted, however, till to-day the revenue entries are not changed.
4. In that view of the matter, these writ petitions are disposed of with a direction to the 3rd respondent – Tahsildar of Bengaluru South Taluk to consider the prayer of the petitioners’ for change of katha in accordance with law within a period of two months from the date of receipt of a copy of this order.
Learned Additional Government Advocate is permitted to file memo of appearance within two weeks from today.
