THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER The suit from which the impugned order emanated having been dismissed today as asserted by the learned counsel for the respondents, the prayer sought in this petition has rendered infructuous.
Accordingly, petition stands disposed off as having become infructuous.
Liberty is reserved to the petitioner to make the impugned order a ground in the appeal as provided under Section 105 read with Order XLIII Rule 1A of CPC, 1908, if & when he chooses to lay a challenge to the decree in question.
All contentions of the parties are kept open.
