This Writ Petition is filed for a Mandamus to set aside the proceeding in Rc.No.E/2465/2014, dated 26-09-2014, issued by respondent No.3 whereby he has suspended the petitioner’s authorization in respect of fair price shop No.19 of Bakaram Jagir Village, Moinabad Mandal, Ranga Reddy District.
From the petitioner’s own averments in the Writ Petition, it is evident that assailing the impugned suspension order passed by respondent No.3, he has availed the remedy of appeal and that the same is pending before respondent No.2. The petitioner cannot, therefore, invoke two parallel remedies for questioning the same order.
Realising the fact that the nature of the order questioned in the appeal as well as in this Writ Petition is an interim order of suspension pending enquiry, Mr.Bollam Lingaiah Yadav, learned Counsel for the petitioner, requested for a direction to respondent No.3 to complete the enquiry and pass a final order within a reasonable time.
In the light of the above facts and the submission of the learned Counsel for the petitioner, this Writ Petition is disposed of without interfering with the impugned order and with the direction to respondent No.3 to complete the enquiry and pass a final order within two months from the date of receipt of this order.
As a sequel, WPMP.No.38153 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
