No.10618/2018 for the offence punishable under Sections 323, 504, 498A, 506 r/w Section 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 against the petitioner and etc., THIS PETITION IS COMING ON FOR ADMISSION, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Parties are present in the Court. 2nd respondent is represented by her counsel Smt. Kalpana T.M.
2. Before ordering notice, parties have settled their score in respect of their matrimonial dispute r/w the criminal proceedings initiated by the 2nd respondent Smt. D. Leelavathi. Joint affidavit dated 23.09.2019 is taken on record. 1st petitioner who is husband of 2nd respondent paying a sum of Rs.10,00,000/- (Rupees Ten lakhs only) by way of Demand Draft No.923960 dated 19.08.2019 drawn on Canara Bank, Bidadi Branch, Bengaluru to respondent No.2 as a full and final settlement.
3. Today learned counsel for the petitioner furnished the Demand Draft bearing No.923960 drawn on Canara Bank, Bidadi Branch, Bengaluru which is in favour of the 2nd respondent has been handed over to her counsel Smt. Kalpana T.M.
4. In view of the joint affidavit dated 23.09.2019 relates to settling the score among the petitioner and 2nd respondent, proceedings arising out of C.C. No.10618/2018 for punishable under Sections 498A, 504, 506, 323 r/w 34 of IPC and Sections 3 and 4 of Dowry Prohibition Act, 1961 is set aside. Petition stands allowed.
