THIS WP COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER In the instant petition, the petitioner has sought for the following reliefs:
"1) Issue writ in the nature of mandamus directing the respondents to set right the anomaly in fixation of pay of the petitioners to be equated to that of his junior Sri M.R. Rangaswamy & Sri R. Veerappa w.e.f. 1.4.2003.
2) Issue writ in the nature of mandamus directing the respondents to pay all the arrears and benefits consequent to the re-fixation and setting right the disparity of pay.
3) Pass such other orders as deemed fit under the circumstances of the case.”
2. The petitioner is stated to have been denied fixation of pay on par with his juniors namely, Sri M.R. Rangaswamy and Sri R. Veerappa w.e.f. 1.4.2003. In this regard, the matter is pending before the concerned authority who has not taken decision as to whether the petitioner is entitled to pay fixation on par with the aforesaid persons w.e.f. 1.4.2003 or not. Till today, the concerned respondent has not filed statement of objections.
3. Having regard to the relief sought in the present petition, the concerned respondent is hereby directed to consider the grievance of the petitioner in fixing the pay of the petitioner on par with the aforesaid persons w.e.f. 1.4.2003 if the petitioner is found otherwise eligible. In this regard, necessary speaking order shall be passed by the competent authority within a period of two months from the date of receipt of copy of this order and communicate the decision/order to the petitioner. Accordingly, the petition is disposed of.
