O R D E R Sri. S.Rajashekar, learned Counsel for the petitioner.
Sri. Vijaykumar A.Patil, learned Additional Government Advocate for Respondents.
The petition is admitted for hearing. With the consent of learned Counsel for the parties, the matter is heard finally.
2. In this writ petition, petitioner, inter alia, seeks the writ of certiorari to quash the order dated 25.11.2016 passed by Respondent No.3. Petitioner also seeks writ of mandamus directing the Respondent No.3 to provide Gunman which was provided to him in pursuance of the order dated 07.03.1996 passed by this Court in W.P.No.1640/1996 vide Annexure-B.
3. When the matter is taken up today, learned counsel for the petitioner submits that after the impugned order dated 25.11.2016 was passed, the petitioner has submitted a representation vide Annexure-M and the writ petition may be disposed of with a direction to the Commissioner of Police, Mangalore, to decide the representation of the petitioner by a speaking order in accordance with law.
4. On the other hand, learned Additional Government Advocate submits that in case such a representation is submitted, the same will be considered after affording an opportunity of hearing to the petitioner.
5. In view of the submissions made and in the facts of the case, the writ petition is disposed of with a direction to the competent authority to consider and decide the representation submitted by the petitioner by a speaking order within a period of one month from the date of receipt of a certified copy of the order passed today.
