Divakar Maddur., HCGP) ...Petitioner ...Respondent This Criminal Petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Crime No. 273/2017 of Mico Layout Police Station, Bangalore City for the offences P/U/Ss 376, 506 of IPC and Section 3(1)(x)(xii) of SC/ST (POA) Act, 1989.
This Criminal Petition coming on for Orders, this day, the Court made the following:
O R D E R The present petition has been filed by the petitioner/accused No.1 under Section 439 of Cr.P.C., seeking his release on bail in Crime No.273/2017 of Mico Layout Police Station for the offences punishable under Sections 307 and 506 of IPC and also Section 3(1)(x)(xii) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
2. I have heard the learned High Court Government Pleader for respondent – State. Learned counsel for the petitioner/accused No.1 has remained absent.
3. Learned High Court Government Pleader submitted the judgment dated 03.11.2018 passed by the file of LXX Additional City Civil and Sessions Judge and Special Judge, Bengaluru City (CCH - 71) in S.C.
No.868/2017, the petitioner/accused No.1 had been acquitted from the charges leveled against him and copy of the judgment was also made available.
4. On going through the said judgment, the petitioner/accused – Parashuram has been acquitted for the offences punishable under Sections 376 and 506 of IPC and also Section 3(1)(x)(xii) of SC and ST (POA) Act, 1989.
5. Under the said facts and circumstance, the present petition has become infructuous and the same is not maintainable. Hence, petition stands dismissed.
