(BY SRI CHETAN DESAI, HCGP.) …PETITIONERS ...RESPONDENT THIS CRIMINAL PETITION IS FILED UNDER SECTION 439 OF CR.P.C., PRAYING TO ENLARGE THE PETITIONERS ON BAIL IN CRIME NO.12/2017 OF KADUGODI POLICE STATION, BENGALURU CITY, FOR THE OFFENCES P/U/S 498(A) AND 304(B) R/W 34 OF IPC AND SEC.4 OF D.P.ACT.
THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioners/accused and the learned High Court Government Pleader appearing for the respondent-State.
2. The petitioners (A-1 and A-2) along with co- accused are charge sheeted by the respondent-police in respect of the offences punishable under sections 498-A, 304-B r/w section 34 of IPC and sections 3 and 4 of the Dowry Prohibition Act.
3. The petitioners are the husband and Father-in- law of the victim of the incident viz., Tejaswini Reddy. The allegation is, the 1st petitioner married the deceased as per custom on 12.3.2015 on receiving dowry in cash and kind. Still, the accused/husband and the in-laws used to pester the deceased for additional dowry and insisted her to transfer immoveable properties standing in her name. When she was carrying pregnancy, she was forcibly made to undergo miscarriage. Thereafter, she was sent to her parents house with a direction not to enter the matrimonial home unless she gets the additional dowry, property etc., On the said occasion, she had to lodge a complaint against the petitioners and their relatives before the Ananthapur Women Police Station on the allegation of dowry harassment etc., She came to Bengaluru in search of a job and committed suicide during July 2016. The co-accused are all on bail. The investigation since complete, having regard to the nature of allegation, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioners are enlarged on bail in Crime No.12/2017 of respondent-police, subject to the following conditions:
(i) They shall execute a self bond for a sum of Rs.2,00,000/- each with two local sureties for the likesum to the satisfaction of the concerned Court.
(ii) They shall attend the Court on all hearing dates regularly and punctually.
(iii) They shall not terrorize the prosecution witnesses.
