THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.20380 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the 3rd respondent in issuing the suspension order dated 3-6-2014 as contrary to the rules and regulations of APSRTC., and contrary to the APSRTC Employees CC&A regulations 1967, arbitrary, unjust, discriminatory and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to permit the petitioner to perform duties as conductor.
The petitioner was suspended on the ground that he consumed alcohol while discharging his duties on 18-
5-2014 and the enquiry is pending.
The learned counsel appearing for the petitioner submits that the petitioner is not guilty of any misconduct and he was unnecessarily issued a charge sheet making the aforesaid allegation and he was kept under suspension.
The learned standing counsel appearing for the respondents corporation submits that in view of the gravity of the misconduct, the suspension order is not supposed to be revoked.
Under these circumstances, the respondents are directed to proceed with the enquiry forthwith and complete the same as expeditiously as possible within a period not later than three months from the date of receipt of copy of this order.
Accordingly, the writ petition is disposed of at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
