O R D E R Accused in C.C.No.387/2014 who is facing the prosecution for alleged offence punishable under Section 138 of Negotiable Instruments Act, 1881, is before this Court calling in question the order dated 04.05.2017 dismissing the application filed by the accused under Section 311 of Cr.P.C.
2. Status in the website of trial Court discloses that matter before the trial Court in C.C.No.387/2014 pending before the Prl. Civil Judge & JMFC, Chikkaballapura, has been disposed of on 12.10.2018 by convicting and sentencing the accused/petitioner. Hence, present petition wherein the interim order has been challenged, has become infructuous. Accordingly, petition stands dismissed as having become infructuous.
In view of petition having been dismissed, I.A.No.1/2017 for stay does not survive for consideration and it is rejected.
