… RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE R-1 AND R-2 TO CONSIDER THE REQUEST OF THE PETITIONER FOR DE NOVO INVESTIGATION OF THE CRIME REGISTERED IN UDR NO.18 OF 2014 ON THE FILE OF THE NONAVINAKERE POLICE STATION, TIPTUR RURAL, TUMKUR, VIDE ANNEX-B BY THE CORPS OF DETECTIVES AND TO INITIATE FURTHER ACTION BASED ON THE SAID REPORT AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Mr.N.D.Jayadevappa, learned counsel for the petitioner.
Mr.Vijay Kumar A.Patil, learned Additional Government Advocate for respondents.
2. The writ petition is admitted for hearing.
With consent of the learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia has prayed for a writ of mandamus directing respondent nos.1 and 2 to consider the request of the petitioner for de novo investigation of the Crime registered in UDR No.18 of 2014.
4. When the matter was taken up today, learned Additional Government Advocate while inviting the attention of this Court to the objections filed on behalf of respondents, submitted that the investigation of the aforesaid UDR No.18 of 2014 is complete and the report has already been filed before the executive Magistrate.
5. In view of the aforesaid submission, learned counsel for the petitioner seeks leave of this Court to withdraw the petition with liberty to take recourse to such remedy as may be available to him under law.
With the aforesaid liberty, petition stands disposed of.
