… Petitioner … Respondent This writ petition is filed under Article 227 of the Constitution of India, praying to set aside the impugned order dated 06.10.2018 passed by learned Principal Civil Judge and JMFC, Malur in Miscellaneous Petition No.15/2016 (Vide Annexure-J) and order dated 13.07.2016 (On IA.No.IX(A) in O.S.No.287/2009 passed by the Learned I Additional Civil Judge and JMFC at Malur vide Annexure-F and may be please to restore O.S.No.287/2009 on board for adjudication in accordance with law.
This petition coming on for Orders, this day, the court made the following:-
2 ORDER Learned counsel for the petitioner has filed a memo dated 26.07.2019 seeking withdrawal of the writ petition.
Memo is placed on record. Accordingly, the Petition stands dismissed as withdrawn in terms of memo.
Registry shall return the impugned order to the petitioner after retaining a copy in the file. It is needless to mention that the time spent in prosecuting this petition shall be discounted while computing the period of limitation for pursuing other remedy.
