SHIVAREDDY, HCGP) … RESPONDENTS THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO ISSUE DIRECTIONS TO THE R-1 TO THE GOVERNMENT OF KARNATAKA FOR APPOINT OF ADMINISTRATOR TO THE R-4 KFCC SOCIETY AS RECOMMENDED EARLIER BY THE R-2 AS PER HIS LETTER DATED 23.10.2017 AS PER ANNEXURE – B WHICH WAS FORWARDED THE SAME TO THE R-1 AND ETC., THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:-
ORDER Sri. G. R. Mohan, learned counsel for the petitioner.
Sri. V. Shivareddy, learned High Court Government Pleader for respondent Nos.1 and 2.
Taking into account the order which this Court proposes to pass, it is not necessary to issue notice to respondent Nos.3 and 4.
2. The petition is admitted for hearing. With the consent of learned counsel for the parties, the same is heard finally.
3. In this petition, the petitioner inter alia has prayed for the following relief:
“(a) Issue a writ of mandamus or directions to the 1st Respondent to the Government of Karnataka for appointment of Administrator to the 4th Respondent KFCC Society as recommended earlier by the 2nd Respondent as per his letter Bearing No.DRB. 4/ SOR/ Compt/ 30/ 2017 - 18 dated 23.10.2017 as per Annexure-B which was forwarded the same to the 1st Respondent.”
4. When the matter was taken up today, learned counsel for the petitioner submitted that the writ petition be disposed of with a direction to the District Registrar to consider and decide the representation dated 08.07.2019 contained in Annexure-D by a speaking order within a fixed time limit.
5. On the other hand, learned High Court Government Pleader submitted that suitable action shall be taken in accordance with law.
6. In view of the aforesaid submissions and in the facts of the case, the petition is disposed of with a direction to respondent No.2-District Registrar to consider and decide the representation submitted by the petitioner in accordance with law by a speaking order after affording an opportunity of hearing to the petitioner within a period of four weeks from today.
7. It is made clear that this Court has not expressed any opinion on the merits of the case.
Accordingly, the petition is disposed of.
