RESPONDENT THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT THE RESPONDENT AUTHORITY TO CONSIDER THE REPRESENTATION OF THE PETITIONER DATED 03.12.2018 VIDE ANNEXURE-G AND DIRECT THE RESPONDENTS TO EXECUTE THE ABSOLUTE SALE DEED IN FAVOUR OF THE PETITIONER, IN RESPECT OF SITE BEARING NO.510- SCR-C, SITUATED AT SURYANAGARA 2ND STAGE, BANGALORE.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING, THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Sri. Niranjan Swamy H.M., learned counsel accepts notice for respondent. The learned counsel is permitted to file memo of appearance for the respondent within a period of four weeks.
2. The petitioner has filed this petition seeking directions to the respondent – Karnataka Housing Board to consider his representation dated 03.12.2018 contending that the respondent has allotted Site No.510/SRC-C in Suryanagar, II Phase pursuant to the application filed by the petitioner on 11.02.2013 and the petitioner has deposited initial amount of Rs.19,821/-. After the issuance of the allotment letter dated 23.02.2013, the petitioner has paid different amounts, in all a sum of Rs.1,78,687/-, but no Sale Deed is executed.
3. Sri. Niranjan Swamy, the learned counsel for respondent submits that the petitioner’s request for execution of the Sale Deed pursuant to the allotment would be considered and appropriate endorsement/communication will be issued by the respondent to the petitioner within six weeks.
4. In view of the facts and circumstances of the case, as well as the submissions, the writ petition is disposed of directing the respondent to consider the petitioner’s representation dated 03.12.2018 and also issue appropriate endorsement/communication of such decision within a period of six weeks from the date of receipt of a certified copy of this order.
