THESE PETITIONS COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R The petitioner has sought for a direction to respondent to allot a site to him in terms of the promises made to allot a site at the rate specified in their letter dated 14.07.1976 as per Annexure – B to the writ petitions.
2. The petitioner is claiming to be a senior citizen who has lost his property bearing Site No.27, Sy.No.26, Sunkenahalli, Kasaba Hobli, Bengaluru North Taluk, on acquisition by the respondent. The said property was said to have been purchased by the petitioner under a registered sale deed executed in his favour by his vendor Sri. M. Mariyappa. The said site having been acquired, the petitioner has made several representations and requests to respondent – BDA to allot an alternative site but the same has not yielded any positive results. Hence, these writ petitions.
3. Learned counsel for the respondent – BDA would submit that there is no legal impediment for the respondent to consider the representation dated 12.03.2014 submitted by the petitioner at Annexure – E to the writ petitions in accordance with law.
4. The said submission is placed on record.
5. In the circumstances, this Court is of the considered view that interest of justice would be sub- served in directing the respondent - BDA to consider the representation of the petitioner dated 12.03.2014 at Annexure – E to the writ petitions in accordance with law and take a decision in an expedite manner, in any event, not later than eight weeks from the date of receipt of certified copy of the order. Ordered accordingly.
With the aforesaid observations and directions, the writ petitions stand disposed of.
