Respondent This Criminal Revision Petition is filed under Section 397 read with 401 of Cr.P.C. praying to set aside the judgment dated 15.02.2018 passed by the LII Additional City Civil and Sessions Judge, Bengaluru in Crl.A.No.1523/2017 and judgment dated 03.10.2017 passed by the XV Additional C.M.M., Bengaluru, in C.C.No.25357/2016 in convicting the petitioner/accused for the offence punishable under Section 138 of N.I. Act and acquit the petitioner and etc.
This Criminal Revision Petition coming for Orders on this day, the court made the following:
ORDER Both the petitioner and the respondent appeared before the Court along with their respective counsel and have filed a joint compromise application under Section 147 of the Negotiable Instruments Act, 1881.
2. Both the parties submitted before the Court that they have settled their dispute amicably and petitioner- accused has paid the entire amount to the respondent- complainant.
3. In view of the settlement arrived between the parties, the Judgment of conviction passed by the XV Additional Chief Metropolitan Magistrate, Bengaluru City, in C.C.No.25357/2016 and the judgment dated 15.02.2018 passed by the LII Additional City Civil and Sessions Judge, Bengaluru City, in Crl.A.No.1523/2017 are set aside. Accordingly, I.A.No.1/2019 is allowed.
4. The petitioner is acquitted of the charges leveled against him under Section 138 of the Negotiable Instruments Act, 1881. His bail, if any, bond stands cancelled.
Accordingly, criminal revision petition is disposed off.
