JUDGMENT / ORDER

IN THE HIGH COURT OF KARNATAKA AT BENGALURU DATED THIS THE 28TH DAY OF AUGUST, 2019 PRESENT THE HON’BLE MR.ABHAY S. OKA, CHIEF JUSTICE AND THE HON’BLE MR.JUSTICE MOHAMMAD NAWAZ WRIT PETITION NO.33969 OF 2019 (GM-POLICE) BETWEEN:
SRI N.P.AMRUTHESH AGED ABOUT 56 YEARS S/O.LATE N.C.PUTTASWAMY ADVOCATE, HIGH COURT 1/1, 7TH CROSS, 15TH MAIN KURUBARAHALLI, J.C.NAGAR BENGALURU-560 086 ... PETITIONER (BY SHRI VIKAS M. AND SHRI RAHUL RAI, ADVOCATES) AND:
THE STATE OF KARNATAKA THROUGH VIDHANA SOUDHA POLICE STATION REPRESENTED BY STATE PUBLIC PROSECUTOR HIGH COURT OF KARNATAKA BENGALURU-560 001 ... RESPONDENT (BY SHRI S.S.MAHENDRA, AGA) ---
THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RESPONDENT TO REGISTER THE FIR AND INVESTIGATE IN ACCORDANCE WITH LAW UPON THE COMPLAINT DATED 23.07.2019 (ANNEXURE-A) MADE BY THE PETITIONER AND ETC.
THIS PETITION COMING ON FOR ORDERS THIS DAY, CHIEF JUSTICE MADE THE FOLLOWING:
ORDER The learned Additional Government Advocate has tendered across the Bar a copy of the First Information Report registered under Section 154 of Code of Criminal Procedure, 1973 by Vidhana Soudha Police Station on 10th August 2019 on the basis of the complaint filed by the present petitioner. Apart from the issue whether the relief claimed could be granted, the substantive prayer was for directing the respondent to register the First Information Report. The said prayer does not survive. It is obvious that the Investigating Officer is bound to carry out the investigation very promptly and efficiently in accordance with law.
Subject to what is observed above, there is no reason to interfere with the writ petition in the nature of a public interest litigation and the same is disposed of.
