... RESPONDENTS (BY SRI. AMIT DESHPANDE, ADVOCATE FOR R2 SMT. M. S. PRATHIMA, AGA FOR R1) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECT R-2 TO SEND LPC AND NOC TO THE PETITIONER PARENT DEPARTMENT AFTER PAYING ALL HIS ELIGIBLE CLAIMS AND ALSO ISSUE DETAILS OF GPF AND IT DEDUCTIONS TO AVAIL HIS PENSION AND PENSIONARY BENEFITS AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER R. DEVDAS J., (ORAL):
The petitioner is a retired Assistant Executive Engineer. The petitioner was originally appointed in the Public Works Department, Government of Karnataka. It is an admitted fact that the petitioner was later deputed to the 2nd respondent – BBMP by order dated 14.12.2015. The petitioner has attained age of superannuation on 28.02.2018. The grievance of the petitioner is that he is still due to receive arrears of payment from the 2nd respondent-BBMP and Last Pay Certificate (LPC) and No Objection Certificate (NOC) are required to be forwarded by the 2nd respondent-BBMP to the parent department of the petitioner. In this regard, the petitioner has made several representations and the last of them is dated 02.05.2018, at Annexure-Z.
2. On hearing the learned counsels and on perusing the writ papers, this Court is of the opinion that the interest of justice would be met if a direction is issued to the 2nd respondent-BBMP to consider the representation given by the petitioner. The 2nd respondent-BBMP is therefore directed to consider the representation of the petitioner and do the needful.
3. The 2nd respondent-BBMP is directed to do the needful within a period of five weeks from the date of receipt of certified copy of this order.
With these observations, the writ petition is disposed of.
