WRIT PETITION No.13361 of 2014 ORDER:
The petitioner claims to be the owner and possessor of open Plot Block-A admeasuring 893.42 square yards in Survey Nos.8/Part, 9/ and 9/ situated at Upperpally Village, Rajendranagar Mandal & G.H.M.C., Ranga Reddy District. He has given the said land for development and after construction of a multi-storied building therein, Flat Nos. 101, 103, 204, 302, 303, 404, 501 and 502 fell to his share. The petitioner intended to sell Flat No.101 of first floor of the said building along with car parking, with undivided share of land admeasuring 46.60 square yards and on 25.02.2014, he and the purchaser approached the Sub-Registrar, Rajendranagar (4th respondent), and presented the deed of sale. The grievance of the petitioner is that even though the said document was received and assigned P.No.49/14 on 25.02.2014, so far neither the document is released nor reasons are assigned as to why the document is kept pending.
The learned counsel for the petitioner submits that a direction be issued to the Sub- Registrar, Rajendranagar (4th respondent) to process and release the document and if there are any objections for processing and registering the document, the reasons for such refusal may be communicated to the petitioner.
Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the Sub-Registrar, Rajendranagar (4th respondent) to process the document bearing P.No.49/14 in accordance with the Registration Act, 1908, and the Indian Stamp Act, 1899; and if the document cannot be processed for registration, the 4th respondent shall assign reasons and communicate the same to the petitioner within two weeks from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this writ petition, shall stand closed.
