Respondent This Criminal Revision Petition is filed under Section 397 r/w 401 of Cr.P.C., praying to set aside the impugned order dated 03.05.2017 passed by the LXVI Additional City Civil and Sessions Judge, Bengaluru in Crl.A.No.1256/2016 by confirming the conviction judgment passed by the XVI Additional C.M.M., Bengaluru in C.C.No.209/2016 dated 28.09.2016 and remand the matter for fresh trial and etc., This Criminal Revision Petition coming on for ‘Orders’ this day, the Court made the following:
ORDER There is no representation on behalf of the petitioner/accused.
2. As per the Police report, the respondent is not residing in the giving address.
3. Though this Court vide order dated 27.08.2019 permitted the learned counsel for the petitioner/accused to retire from the case, but however the Court notice was issued to the petitioner through the concerned Police. The concerned Police of Byatarayanapura Police Station have filed their report stating that the named person has vacated the said house about one year back and there is no other information about his present address. That itself clearly goes to show that the petitioner/accused is not interested in pursuing the case. Hence, the Criminal Revision Petition is dismissed.
