THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent.
2. The respondent-police have registered a FIR in their Cr.No.60/17 against the petitioner (A-2) and others in respect of the offences punishable under sections 427, 307, 448, 504, and 506(B) r/w section 34 of IPC and section 2 of Prevention of Destruction and Loss of Property Act, 1981.
3. The 1st accused is absconding. A-3 and A-4 are juveniles in conflict with law against whom a charge sheet is said to have been filed, before the Juvenile Justice Board.
4. The allegation of the prosecution is, with an intention to create commotion in the area, on 14.1.2017 the accused persons committed rioting with deadly weapons, barged into the house of CW-1, damaged the show case glass and threatened CW-1 with dire consequence and put threat to her life. Investigation since complete, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioner is enlarged on bail in Crime No.60/2017 of respondent-police, subject to the following conditions:
i) He shall execute a self bond for a sum of Rs.50,000/- with one local surety for the likesum to the satisfaction of the concerned Court.
The surety shall produce his original title deeds pertaining to the immovable properties and his identity/Aadhar card for perusal of the Court. He must not have previous history of offering surety to any accused in any other criminal case so far.
ii) He shall attend the Court on all hearing dates regularly and punctually.
iii) He shall mark his attendance before the S.H.O of the respondent-police on every alternate Tuesday till conclusion of trial.
iv) He shall not terrorize the prosecution witnesses.
v) He shall not indulge in criminal activities.
