(BY SRI KALEEMULLAH SHARIFF, ADVOCATE) AND THE MANAGING DIRECTOR KARNATAKA SOAPS AND DETERGENT LTD CORPORATE OFFICE SRIGANDHANAGAR BENGALURU-560055.
... PETITIONER ... RESPONDENT THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE IMPUGNED ENDORSEMENT DATED 12.10.2018 PRODUCED AT ANNEXURE-D AND ETC.
THIS WRIT PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER R. DEVDAS J., (ORAL):
The petitioner was working with the respondent- Karnataka Soaps and Detergent Ltd., Bengaluru. It is the contention of the petitioner that though he was born on 22.10.1960, at Bellary and the date of birth registered in the office of the City Municipal also being 22.10.1960, but the date of birth shown in the SSLC marks card is 01.07.1959. In this regard, the petitioner made a representation to the respondent on 24.09.2018, seeking the correction of the date of birth and entry in the service records. The respondent issued an endorsement dated 12.10.2018, rejecting the representation of the petitioner.
3. The only ground on which the petitioner seeks change in the date of birth is that, he recently came to know that his correct date of birth is 22.10.1960 and therefore, he seeks for correction of the date of birth in the service records. There is absolutely no legal ground made out in the petition. The provisions of law covering the entry of date of birth and under what circumstances correction of date of birth could be made has not been adverted to. A Government servant/employee of a Government undertaking is permitted to seek correction of date of birth within a specified period after entry into service. Moreover, the petitioner is going to retire on 30.06.2019. At the fag end of the career, it is not permissible under law to make correction in the date of birth and extend the age of superannuation of the petitioner. No ground is made out in the writ petition. Therefore, the writ petition is dismissed.
