ORDER:
This writ petition is filed for the following substantive relief:
“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, to set aside the Notice of Sale dt.09.10.2014 passed in E.P.No.01/CTCUB/2013 by the 2nd respondent.”
At the hearing, Sri G.N.S.Chandra Bose, learned counsel for the petitioner, requested for permission of the Court to withdraw the writ petition with liberty to his client to file a fresh writ petition with proper and complete Annexure-I.
The writ petition is accordingly dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel to dismissal of the writ petition, W.P.M.P.No.40051 of 2014 shall stand disposed of as infructuous.
