This writ petition has been filed praying for quashing of the judgement and order dated 8.8.2012 passed by the Additional District Judge/Special Judge(E.C. Act), Meerut in S.C.C. Revision No. 127 of 2010( Abdul Kayum Vs. Manzoor Ahmad).
The petition relates to the proceedings arising out of the S.C.C. suit, the petition under Article 226 of the Constitution of India is not maintainable, in view of the judgement passed by the Apex court in the case of Radhey Shyam Vs. Chavi Nath, (2015) 5 SCC,423. Petitioner may file proper application for converting this writ petition into Misc. petition under Article 227 of Constitution of India, if so advised.
