(By Sri.S.Chandrashekaraiah, HCGP) …Respondents This Criminal Petition is filed under Section 482 of Code of Criminal Procedure praying to quash the order dated: 03.07.2017 passed by the Civil Judge (Jr.Dn) and JMFC, Periyapatna in PCR.No.138/2017 by directing the 1st respondent Police to register the case and investigate and submit final report and in consequence quash the FIR registered by the 1st respondent police in CR.No.214/2017, Dated: 12.07.2017 for the offences P/U/S 420, 468 R/w 34 of IPC and its further proceedings against the petitioners, before the Civil Judge (Jr.Dn) and JMFC, Periyapatna and etc.
This Criminal Petition coming on for Orders this day, the Court made the following:
ORDER Perusal of the records would indicate that on account of non-compliance of office objections, matter has been listed on more than three occasions. In spite of peremptory order passed granting time to pay the costs, neither cost has been paid nor office objections have been complied. Even today, there is no representation. This only indicates that petitioner is not interested in prosecuting this petition. Hence, petition is dismissed.
In the event of an application for recall of the order is filed, Registry is directed to list the said application, only on receipt for having deposited the cost being enclosed.
