Prathima, AGA) …Petitioner …Respondents This writ petition is filed under Articles 226 and 227 of the Constitution of India, praying to quash the provisional selection list dated 04.07.2019, issued by the Karnataka Public Service Commission, Bengaluru vide Annexure-H and etc., This writ petition coming on for Preliminary Hearing this day, the court made the following:
ORDER Petitioner has sought for quashing of the provisional selection list dated 04.07.2019 issued by the Karnataka Public Service Commission (Annexure-H) relates to selection to the post of Motor Vehicle Inspector, Department of Transport, Government of Karnataka.
2. Post of Motor Vehicle Inspector is governed by Rules of Recruitment issued under Article 309 of the Constitution read with the Karnataka State Civil Services Act, 1978. Petitioner’s grievance is against a civil post. Therefore, he has remedy before the State Administrative Tribunal, in view of the decision of the Hon’ble Supreme Court in the case of L.Chandra Kumar Vs. Union of India reported in (1997) 3 SCC 261 read with Shiva Prasad Biradar Vs. Karnataka Lokayuktha and others in Writ Appeal No.200715/2018 disposed off on 11.03.2019.
Accordingly, writ petition is not maintainable. Petition stands dismissed reserving liberty to the petitioner to approach the appropriate forum in accordance with law.
