This Crl.P. is filed under Section 482 Cr.P.C. with a prayer to quash/set aside the order dated 05.12.2013 passed by learned Civil Judge and JMFC at Alur in Crl. Misc. No. 158/2012 and etc.
This Crl.P. coming on for Admission this day, the Court passed the following;
O R D E R Petitioner has preferred this petition against the concurrent findings of the Courts below directing the petitioner to pay maintenance at the rate of Rs.2,000/- per month to the respondent.
2. The respondent is the father of the petitioner.
Since the petitioner failed to look after and maintain the respondent, he was constrained to invoke Section 125 of Cr.P.C. and after recording evidence, the learned Magistrate directed the petitioner to pay maintenance at the rate of Rs.2,000/- per month to the respondent from the date of petition till the life time of the respondent. The revisional Court has confirmed the said order. Both the Courts below have taken into consideration the means and capacity of the petitioner to pay the maintenance awarded by the trial Court as well as the needs and requirement of the respondent. Under the said circumstances, I do not find any error or infirmity in the impugned orders warranting interference by this Court. Consequently the petition is dismissed.
