JUSTICE RATHNAKALA CRIMINAL PETITION NO.6917/2017 Between Sri Mangalpady Naresh Shenoy, S/o. Late Namdev Shenoy, Aged about 39 years, R/at D.No.13-10-1279/2, Dhanvanthri Nagar, V.T.Road, Mangalore, D.K.District-575 001. …Petitioner (By Sri Aruna Shyam M., Adv.) And The State of Karnataka, Through Barke Police Station, D.K.District, Rep. by State Public Prosecutor, High Court Buildings, High Court of Karnataka, Bengaluru- 560 001. ...Respondent (By Sri S. Vishwamurthy, HCGP) This Criminal Petition is filed under Section 439 (1) (b) of Cr.P.C., praying to modify the bail order dated 15.09.2016 passed by this Court in Crl.P.No.6189/2016 in so far as the condition No.(1) which reads as “ Petitioner shall keep himself away from all the activities and affairs of Shri Venkataramana Temple, Car Street, Mangalore and Kashimatt, Mangalore and from the affairs and activities of all the committees attached to the said temple till conclusion of the trial of the case”.
This petition coming on for Orders, this day, the Court made the following:
ORDER This petition is filed seeking relaxation of the condition imposed on the petitioner in his bail petition in Crl.P.No.6189/2016 dated 15.09.2016. The petitioner is aggrieved by the conditions, which reads thus:
“ Petitioner shall keep himself away from all the activities and affairs of Shri. Venkataramana Temple, Car Street, Mangaluru and Kashimutt, Mangaluru, and from the affairs and activities of all the committees attached to the said temple till conclusion of the trial of the case”.
2. It is the submission of the learned counsel for the petitioner that the petitioner is a devotee of the Temple and Mutt. He intends to offer his prayer in the temple attached to the mutt. The above condition is coming in his way of offering prayer. Hence, the said condition be relaxed.
3. It is clear that there is no prohibition on him by the impugned order from offering prayer as a devotee in the temple and mutt. He is only conditioned from keeping himself away from the activities and affairs of the committees attached to the temple.
In that view of the matter, there is no merit in the petition. Hence, the petition is rejected.
