THIS WRIT PETITION COMING ON FOR FINAL HEARING THIS DAY, CHIEF JUSTICE MADE THE FOLLOWING:
ORDER Heard the learned Senior Counsel appearing for the petitioners, the learned Additional Government Advocate appearing for the first and second respondents and the learned counsel appearing for the third respondent.
2. There is no dispute that only prayer (ii) survives for consideration. By notification dated 10/25th February 2004, the State Government passed an order granting quarry lease for quarrying grey granite to the third respondent.
3. Admittedly, a lease deed has not been executed in terms of the said notification. Therefore, sub-rule (1) of Rule 18 of the Karnataka Minor Mineral Concession Rules, 1994, as applicable at the relevant time, will apply. As lease deed has not been executed within three months from the date of the notification, the notification impugned shall be deemed to have been revoked.
4. Subject to what is observed above, the writ petition is disposed of.
