ON IA 1/17 FOR IMPLEADING) THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO CALL FOR THE ENTIRE RECORDS PERTAINING TO THE IMPUGNED NOTIFICATION DATED 12.07.2016 VIDE ANNEXURE-F ISSUED BY R-1 AND ISSUE WRIT IN THE NATURE OF CERTIORARI TO QUASH THE SAID NOTIFICATION, THE SAME IS WHOLLY UNAUTHORIZED, VOID AND DISCRIMINATORY IN SO FAR AS PETITIONER CONCERNED.
THIS WRIT PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER The petitioner is before this Court assailing the notification dated 12.07.2016 as at Annexure-F to the petition.
2. Though a contention is urged herein that such notification to constitute the Managing Committee of the Temple would not be justified, in view of the amended provision contained in Section 25 of the Hindu Religious and Charitable Endowment Act being struck down by this Court in W.P.Nos.64805-64868/2011 dated 17.11.2015, the fact that the said issue is pending before the Hon’ble Supreme Court in C.C.Nos.6834-6959/2016 is the admitted position. In the said proceedings, the Hon’ble Supreme Court has stayed the operation of the order dated 17.11.2015 passed by the Hon’ble Division Bench of this Court.
3. If that be the position, at this point in time, the provision as contained in Section 25 of the Act is available and as such, the notification dated 12.07.2016 is issued in the light of the said existing provision. Hence, at this juncture, there is no reason for this Court to entertain this petition and interfere with the order/notification impugned herein. However, all action pursuant to such notification would remain subject to result of the decision to be taken by the Hon’ble Supreme Court and in that light, if at that stage, the petitioner becomes entitled to assail any action in that regard, including the constitution of the Managing Committee pursuant to the impugned notification, liberty is reserved to the petitioner to approach this Court at that point in time.
With such liberty, the petition stands disposed of.
