Vijetha.R.Naik, Adv., for R2-Absent) This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure 1973 praying to quash the FIR filed by Respondent No.1 i.e., HAL Police in Crime No.427/2016 dated 12.07.2016 in the Court of the Hon’ble XLIII Additional Chief Metropolitan Magistrate, Mayohall, Bengaluru City and quash the complaint filed by the respondent No.1 on 12.07.2016 etc.
This petition coming on for admission, this day, the Court made the following:
ORDER Heard the learned counsel for the petitioner and perused the petition.
2. Petitioner has sought to quash the FIR in Crime No.427/2016 registered for the offences punishable under Sections.506, 498A, 504 and 323 of IPC.
3. When the matter is taken up for hearing, learned counsel for the petitioner submits that after investigation ‘B’ report has been submitted before the jurisdictional Court and the matter is under consideration of the learned Magistrate.
4. In view of the above submission, the petition does not survive for consideration and accordingly, the petition is dismissed.
However, a direction is issued to the learned Magistrate to consider and pass appropriate order on the ‘B’ report submitted by the investigating officer as expeditiously as possible.
