Order:
This Writ Petition is filed for the following substantive relief: “to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the impugned proceedings of Respondent No.5 in Letter No.417/C1/2014, dt.02.09.2014, in withholding the right of the Gram Panchayat for conducting fishing rights in public auction for the Epuru Gram Panachayat Minor Irrigation Tank as illegal, arbitrary, unconstitutional and contrary to Rules made under Gram Panchayat Act, 1994 and consequentially set aside the same by permitting the Gram Panchayat to hold fishing rights in Raparlavari Tank in Epuru Gram Panchayat and Mandal, Guntur District, from the current academic year, 2014-15 onwards.”
After arguing the case, Smt.V.Sujatha, learned Counsel for the petitioner, requested for permission of the Court to withdraw the Writ Petition with liberty to her client to get herself impleaded in WP.No.27957 of 2014 stated to have been filed by the Sarpanch of Epuru Gram Panchayat for the same relief as claimed in the present Writ Petition or to file a Public Interest Litigation.
The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.
As a sequel, WPMP.No.40254 of 2014, filed by the petitioner for interim relief, is disposed of as infructuous.
