THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, THE COURT MADE THE FOLLOWING:-
O R D E R The petitioner has sought for a direction to the respondent No.2 to pass appropriate orders on the objections dated 29.01.2016 and 01.07.2017 filed by the petitioner opposing the project notification issued by the respondent No.1 dated 16.01.2016 notifying the formulation of scheme for establishing 1 X 8 MVA, 66/1 KV Substation at Bijjalli in Kodihalli Hobali, Kanakapura Taluk, Ramanagara District and construction of 66 KV SC line on DC tower tap line from 66 KV Kodihalli – Hunasanahalli SC Line to proposed 66/11KV Bijjalli Substation.
2. Learned counsel for the respondents has filed statement of objections along with the documents submitting that the petitioner has agreed and received the compensation amount of Rs.2,42,790/- [Rupees Two Lakhs Forty Two Thousand Seven Hundred and Ninety Only] vide cheque bearing No.003040 dated 26.02.2018 for an amount of Rs.1,84,355/- [Rupees One Lakh Eighty Four Thousand Three Hundred and Fifty Five Only] and cheque bearing No.003293 dated 27.04.2018 for an amount of Rs.58,435/- [Rupees Fifty Eight Thousand Four Hundred and Thirty Five Only] towards full and final settlement of compensation inasmuch as the trees as well as the land value and an affidavit is also filed by the petitioner agreeing to withdraw the present writ petition. A copy of the said affidavit is placed on record as Annexure-R6 to the reply.
3. Learned counsel for the petitioner does not dispute the same.
In view of the aforesaid, writ petition stands dismissed as having rendered infructuous.
